An opioid treatment program must obtain a license from the board. This chapter applies to opioid treatment programs that are-
Certified or provisionally certified by the U.S. Department of Health and Human Services, Substance Abuse and Mental Health Services Administration pursuant to 42 CFR Part 8; and Licensed by the Maine Department of Health and Human Services, Division of Licensing and Regulatory Services pursuant to 14-118 CMR Chapter 5, Section 19.8.An opioid treatment program licensed by the board pursuant to this chapter must furnish copies of its federal DHHS certification, DEA number and state DHHS license to the board prior to opening for operation.
Maintenance of federal DHHS certification and state DHHS licensure as set forth above is an ongoing requirement of licensure by the board. Any loss or lapse of federal DHHS certification or state DHHS licensure may result in disciplinary action by the board.
