Section VII-1111 - Applicant and Consumer/Recipient Appeal RightsA. Any individual who is aggrieved by a decision with regard to a request for provision of personal assistance services may appeal said decision within 30 days from the date of the letter informing them of the denial decision taken on the SPAS Program application or reduction in services by requesting an informal administrative review. This request must be made in writing to Louisiana Rehabilitation Services, P.O. Box 91297, Baton Rouge, LA 70821-9297. The findings of the informal administrative review must be determined within 30 days from the receipt of the written request. If the individual is dissatisfied with the finding of this informal administrative review, within 10 days from the date of the informal administrative review decision, the request for a fair hearing must be made in writing to Louisiana Rehabilitation Services, P.O. Box 91297, Baton Rouge, LA 70821-9297. The fair hearing must be held within 30 days of receipt of the request. The impartial hearing officer will make a decision based on the provisions of the Louisiana Rehabilitation Services SPAS Policy Manual and the law and provide to the applicant or consumer, or if appropriate, the representative, and the Director of LRS a full written report of the findings and grounds for the decision within 30 days of the completion of the hearing.B.
