Section XV-903 - ResponsibilityA. The commissioner shall establish a process that includes a database and inventory system for designating lands unsuitable for surface coal mining operations which shall be available to the public.B. The office shall integrate as closely as possible decisions to designate lands as unsuitable for surface coal mining operations with present and future land-use planning and regulatory processes at the federal, state and local levels.C. The office shall establish a process that allows any person, having an interest which is or may be adversely affected, to petition to have an area designated as unsuitable for all or certain types of surface coal mining operations or to have a designation terminated.D. The office shall prohibit or limit surface coal mining operations on certain lands and in certain locations designated by Congress in §522(e) of the Federal Act, 30 U.S.C. 1272(e).La. Admin.
