Section V-1523 - Surveillance and MonitoringA. Primary responsibility for the proper handling of hazardous wastes is assumed by the industry operating under these rules and regulations and cooperating with the department in meeting the purposes of the Act. As part of this responsibility, the owner or operator of any treatment, storage, or disposal facility shall develop a schedule of routine facility inspections and shall keep a log or record of all inspections carried out thereunder. The owner or operator shall likewise develop and adhere to a waste analysis plan to be approved by the department.B. Department surveillance and monitoring includes the following: 1. analysis of manifests and manifest reports to determine that all wastes generated are disposed of in permitted sites and that the proper disposal method has been used;2. periodic inspections required by the permit maintenance program to insure that facilities treating, storing, and disposing of hazardous wastes are operated in conformity with the terms of the permit and these rules and regulations;3. spot inspections and sampling by the traveling laboratory and the analytical and inspection team;4. a systematic program to conduct or to require investigations and recording of the groundwater, leachate, and air monitoring systems;5. response to citizen complaints and suggestions concerning operation of the system; and6. such other procedures as may be deemed necessary by the administrative authority.C. Violations discovered through such surveillance and monitoring shall be the subject of enforcement actions pursuant to LAC 33:V.107 of these regulations.La. Admin. Code tit. 33, § V-1523
