Section I-511 - Recovery of OverpaymentsA. If an overpayment occurs, OGB retains the right to recover the overpayment. The plan participant, institution, or provider receiving the overpayment must return the overpayment. At OGB's discretion, the overpayment may be deducted from future claims. Should legal action be required as a result of fraudulent statements or deliberate omissions on the application for coverage or a claim for benefits, the defendant shall be responsible for attorney fees of 25 percent of the overpayment or $1,000, whichever is greater. The defendant shall also be responsible for court costs and legal interest from the date of judicial demand until paid.La. Admin. Code tit. 32, § I-511
