Section CXXXIX-305 - BESE Duties Relating to Charter SchoolsA. BESE has the following duties relating to charter schools: 1. subject to the availability of funds, to administer loans pursuant to the Charter School Law for assisting in meeting the costs required to establish a charter school as well as the costs of operation;2. to determine the policy and provide direction to the Department of Education for providing oversight of the operation of charter schools chartered by BESE;3. upon the request of any school system with fewer than 5,000 students, to provide technical assistance to the system in determining the potential financial impact of any proposed charter school on the operation of the system;4. to notify local school boards of the receipt of any Type 2 charter school application for a school which is proposed to be located within the district. In addition, the local board as well as other interested groups shall be allowed to provide written information regarding any charter application and be allowed to present information at a scheduled public meeting of BESE prior to any determination being made by BESE; and5. to fulfill all other obligations created by state and federal law with respect to students attending charter schools.La.
