Section 80-45-2 - Substitute school service defined

For the purpose of construing and applying the provisions of K.S.A. 72-5512, a retired school employee:

(a) Shall be considered to be performing school service as a substitute employee when he temporarily replaces a regular employee or when temporarily employed for an unfilled position until such time as a permanent employee can be secured, and when paid a per diem or at an hourly, weekly or monthly rate; and

(b) when performing such substitute service, any fractional part of a day of such performance shall be counted as one day of school service.
