Section 5-22-15 - Limitations on the use of fresh groundwater(a) Fresh groundwater shall not be used for any of the following purposes, unless the applicant demonstrates before approval of the application that the use of other waters is not technologically or economically feasible: (1) The enhanced recovery of oil or gas; (3) the construction of storage caverns in subsurface salt deposits; (4) the displacement and extraction of hydrocarbons from subsurface storage; (5) any use that is not a beneficial use, as defined in K.A.R. 5-1-1; and (6) any use that is not in the public interest. (b) "Other waters" shall include the following: (1) Water having a chloride content of more than 500 milligrams per liter (mg/l); (2) water that is otherwise contaminated so that it is not drinkable; (3) renewable surface water; and (4) water that is being reclaimed, recycled, or reused.
