Section 123-15-101b - Time limit for filing grievance(a) Each grievance shall be filed within 15 days from the date of the discovery of the event giving rise to the grievance. However, if the fifteenth day falls on a Saturday, Sunday, or holiday, the grievance may be filed on the first regular work day immediately following the fifteenth day. No grievance, regardless of the date of discovery, shall be filed more than one year after the date of the event giving rise to the grievance. Each grievance filed later than these deadlines shall be returned to the offender without investigation. The name of the individual returning the grievance, the date of the return, and the reasons for the return shall be noted on the grievance. (b) Any offender may move to the next level of the grievance procedure if a timely response is not received at any level in the grievance process, unless an extension of time for the response is agreed to in writing by the offender and staff person answering the grievance. This regulation shall be effective on and after April 8, 2005.
