Section 123-13-401 - Hearing within certain period; notice to offender; time and place of hearing(a) Except as otherwise provided in these regulations and subject to authorized continuances, the disciplinary hearing to determine the offender's guilt or innocence and to impose a penalty if a finding of guilt is made shall be held not less than 24 hours and not more than seven working days after the offender has been served notice of the charge. (b) Each offender charged with an offense shall be given advance written notice of the time and place of the disciplinary hearing. This notice shall be given not less than 24 hours before the hearing and shall be given by the disciplinary administrator, the hearing officer, or any other person designated by the superintendent. This regulation shall be effective on and after April 8, 2005.
