To obtain an order from the commissioner pursuant to Iowa Code chapter 89B and rule 875-130.2 (89B), an employer shall make a written application to the commissioner setting forth the specific grounds for the claimed exemption. Upon receipt of an application, the commissioner shall give the applicant notice and opportunity to be heard at a full evidentiary hearing before the commissioner.
