Rule 441-106.5 - Denial, suspension, or revocation(1) The administrator may deny an application for issuance or reissuance of a certificate of approval if: a. The applicant or certificate holder, as applicable, fails to comply with these rules or knowingly makes a false statement concerning a material fact or conceals a material fact on the application for the issuance or reissuance of a certificate of approval or in a report regarding operation of the children's residential facility submitted to the administrator.b. The applicant or any person residing in the children's residential facility or any facility staff has a record of founded child abuse unless an evaluation of the founded abuse has been made by the department which concludes that the abuse does not merit prohibition of employment, volunteer work, or certification.(2) The administrator may suspend a certificate of approval if:a. The applicant or certificate holder, as applicable, fails to comply with these rules or knowingly makes a false statement concerning a material fact or conceals a material fact on the application for the issuance or reissuance of a certificate of approval or in a report regarding operation of the children's residential facility submitted to the administrator.b. A children's residential facility's failure to meet the certification requirements poses a danger to the health, safety, or well-being of the children being served.c. A children's residential facility fails to comply with Iowa Code section 282.34.(3) All operations of a children's residential facility shall cease during a period of suspension or revocation of a certificate of approval, including during an appeal. A suspension of a certificate of approval shall not extend beyond six months, and the existence of the condition requiring suspension shall be corrected within six months and documented in the record of the holder of the certificate of approval.(4) Effective period of suspension. A suspension shall be effective on the date the notice is received by the holder of the certificate of approval and shall remain in effect until one of the following occurs:a. The department withdraws the suspension due to a change in conditions in the children's residential facility.b. The court orders the certificate of approval reinstated.c. The action is reversed by a final decision in accordance with 441-Chapter 7.d. The certification period expires.(5) Method and content of notice. The notice of suspension shall be sent by restricted certified mail or personal service and shall include the following: a. The condition requiring the suspension.b. The specific law or rule violated.(6) The administrator may revoke a certificate of approval if: a. The applicant or certificate holder, as applicable, fails to comply with these rules or knowingly makes a false statement concerning a material fact or conceals a material fact on the application for the issuance or reissuance of a certificate of approval or in a report regarding operation of the children's residential facility submitted to the administrator.b. The conditions requiring suspension are not corrected within six months.c. A children's residential facility fails to comply with Iowa Code section 282.34.(7) Right to appeal suspension or revocation. The holder of the certificate of approval has the right to appeal a suspension or revocation of the certificate of approval, but initiation of an appeal does not alter the suspension or revocation. Notices of adverse actions and the right to appeal shall be given to applicants and certificate of approval holders in accordance with 441-Chapter 7 and rule 441-16.3 (17A). (8) Corrective action. The facility shall furnish the department with a plan of action to correct deficiencies that resulted in the suspension or revocation of a certificate of approval. The plan shall give specific dates upon which the corrective action will be completed. This rule is intended to implement Iowa Code section 237C.6.
