Rule 441-81.56 - Duration of remedies
(1)Remedies continue. Except as specified in subrule 81.56(2), alternative remedies continue until:
a. The facility has achieved substantial compliance as determined by the department of inspections and appeals based upon a revisit or after an examination of credible written evidence that it can verify without an on-site visit; or
b. The provider agreement is terminated.
(2)State monitoring. In the cases of state monitoring and denial of payment imposed for repeated substandard quality of care, remedies continue until:
a. The department of inspections and appeals determines that the facility has achieved substantial compliance and is capable of remaining in substantial compliance; or
b. The provider agreement is terminated.
(3)Temporary management. In the case of temporary management, the remedy continues until:
a. The department of inspections and appeals determines that the facility has achieved substantial compliance and is capable of remaining in substantial compliance;
b. The provider agreement is terminated; or
c. The facility which has not achieved substantial compliance reassumes management control. In this case, the department of inspections and appeals initiates termination of the provider agreement and may impose additional remedies.
(4)Facility in compliance. If the facility can supply documentation acceptable to the department of inspections and appeals that it was in substantial compliance, and was capable of remaining in substantial compliance, if necessary, on a date preceding that of the revisit, the remedies terminate on the date that the department of inspections and appeals can verify as the date that substantial compliance was achieved.
