Rule 161-4.29 - Waiver, modification of rules(1)By presiding officer. Upon notice to all parties, the presiding officer may, with respect to matters pending before the presiding officer, modify or waive any rule herein upon a determination that no party will be prejudiced and that the ends of justice will be served.(2)By parties. Unless otherwise precluded by law, the parties in a contested case proceeding may waive any provision of this chapter However, the presiding officer, in the discretion of the presiding officer, may refuse to give effect to such a waiver when the presiding officer deems the waiver to be inconsistent with the public interest.Iowa Admin.
