Sec. 2.
(a) Proceedings under this rule shall be presided over by an administrative law judge appointed under 910 IAC 1-3-5.(b) The administrative law judge shall have all powers necessary to conduct a fair and impartial hearing, including, but not limited to, the following:(1) To conduct hearings in accordance with this rule.(2) To administer oaths and affirmations and examine witnesses.(3) To rule on offers of proof and receive evidence.(4) To take depositions or have depositions taken when the ends of justice would be served.(5) To regulate the course of the hearing and the conduct of parties and their counsel.(6) To hold conference for the settlement or simplification of the issues by consent of the parties.(7) To dispose of motions, procedural requests, and similar matters.(8) To make initial decisions as described under section 9 of this rule.(9) To exercise such powers as are necessary and appropriate for the purpose of the hearing and conduct of the proceeding.
