Sec. 40.
(a) Each issuer shall prepare a service summary at the client's request specifically for the policyholder or certificateholder applying for Medicaid. The issuer shall also prepare a service summary when the policyholder or certificateholder has exhausted his or her benefits under the policy or certificate or when the policy or certificate ceases to be in force for a reason other than the death of the policyholder or certificateholder, whichever occurs first. The issuer shall send the service summary to the policyholder or certificateholder, with a copy sent to OMPP, within thirty (30) days of the date of final payment of qualifying insurance benefits by the issuer.(b) The service summary shall include the following and shall appear in a format prescribed by OMPP: (1) The specific qualified policy or certificate.(2) The total benefits paid for services rendered to date.(3) The amount qualifying for asset protection. This service summary is separate and in addition to the information requirement described in section 38 of this rule.
