Sec. 5.
(a) The hearing examiner shall conduct a hearing to take evidence on the complaint.(b) The hearing shall be conducted in accordance with IC 4-21.5-3 and this rule.(c) Parties shall present evidence and may cross-examine witnesses.(d) All testimony shall be taken under oath.(e) The hearing examiner shall issue a recommended order within ninety (90) days of the later of: (1) the conclusion of the hearing; or(2) submission of post-hearing briefs or proposed findings of fact and conclusions of law.(f) The hearing examiner's recommended order shall include:(2) conclusions of law; and(3) recommended remedy, if applicable.Indiana Education Employment Relations Board; 560 IAC 2-3.1-5; filed 5/24/2018, 11:06 a.m.: 20180620-IR-560170443FRAReadopted filed 8/16/2022, 2:41 p.m.: 20220914-IR-560220222RFA
