Sec. 5.
(a) The provider shall use the adult guardianship assessment instrument developed by the division to assess whether an individual referred to the provider is indigent or incapacitated, or both, and to assist in the development of a service plan to meet the individuals' needs.(b) Within the availability of funds, every individual who is referred to the provider is eligible for an initial assessment.
