Sec. 2.
(a) The requirement to be a registered pesticide consultant shall apply to any retail establishment that does both of the following: (1) Sells or offers for sale any pesticide, except restricted use pesticides, to pesticide users.(2) Has employees who provide pesticide selection and use advice to pesticide users.(b) The requirement to be a registered pesticide consultant shall not apply to the following: (1) Retail establishments that sell pesticides, but whose employees are not expected to provide pesticide selection and use advice.(2) Physicians, pharmacists, and veterinarians that provide pesticide selection and use advice for pesticide products intended for use on humans or animals.(3) An establishment with a valid Indiana pesticide business license as described in IC 15-3-3.6-6[IC 15-3 was repealed by P.L. 2-2008, SECTION 83, effective July 1, 2008. See IC 15-16-5-48.].(4) An establishment with a valid Indiana restricted use pesticide dealer registration as described in IC 15-3-3.6-12[IC 15-3 was repealed by P.L. 2-2008, SECTION 83, effective July 1, 2008.
