Sec. 2.
(a) A person who applies for a permit to operate a transfer station shall establish financial responsibility for the costs of closure and post-closure monitoring and maintenance of the transfer station.(b) The financial responsibility must cover the costs of the following:(1) Properly closing the transfer station in an environmentally sound manner.(2) Monitoring and maintaining the transfer station site during post-closure.(c) Financial responsibility may be established through the mechanisms under 329 IAC 10-39.(d) The amount of financial responsibility a person shall establish for a transfer station must be the greater of one (1) of the following:(1) Four thousand dollars ($4,000) for each acre or part of an acre covered by the transfer station.(2) An amount determined by the commissioner that is sufficient to close the transfer station in a manner that minimizes the need for further maintenance, and provides reasonable, foreseeable, and necessary maintenance during post-closure.(e) The amount of financial responsibility a person shall establish for a transfer station must provide assurance of proper post-closure maintenance for one (1) year after the transfer station has ceased operations.
