Sec. 8.
The following sources and facilities located in Vermillion County shall comply with the sulfur dioxide emission limitations in pounds per million Btu and other requirements:

(A) Upon certification by PSI to the commissioner that the Universal Mine cannot assure a long term supply of compliance coal, final compliance with the four and forty-hundredths (4.40) pounds per million Btu sulfur dioxide emission limitation may be extended until December 31, 1989. The commissioner shall notify the U.S. EPA upon receipt of such a certification by PSI.(B) PSI may at any time petition the commissioner for a four and forty-eight hundredths (4.48) pounds per million Btu final sulfur dioxide emission limitation. The petition shall include evidence that such a limitation will protect the sulfur dioxide ambient air quality standards on all land not fenced or otherwise effectively restricted from public access. If the commissioner approves such a petition, the department shall amend the operation permit according to procedures specified in 326 IAC 2 and submit the revised permit to U.S. EPA.
