Section 326 IAC 6.8-11-5 - Violation of annual standard

Sec. 5.

If there is a violation of the annual ambient air quality standard for PM10 as determined in accordance with 40 CFR 50, Appendix K*, and before a finding of failure to attain by the administrator of the U.S. EPA, the department shall conduct a comprehensive culpability study as described in section 3 of this rule for each occurrence that caused or contributed to the violation. Upon completion of the culpability study, the department shall notify the following sources:

(1) Any source whose total source-wide PM10 emissions contributed more than five (5) micrograms per cubic meter to the total concentration at the sampling site on any of the sampling days that contributed to the violation.
(2) Any source where a specific facility at the source contributed more than one (1) microgram per cubic meter to the total concentration at the sampling site on any of the sampling days that contributed to the violation.

The department's notification shall include the results of the culpability study.
