Sec. 6.
(a) An owner or operator of an air curtain destructor as defined in 326 IAC 1-2-2.5 shall submit an application to the department to obtain a letter of approval from the commissioner or the commissioner's designated agent prior to its installation or operation at a new site. The owner or operator: (1) shall not operate the air curtain destructor unless the owner or operator holds a valid letter of approval; and(2) shall maintain the letter of approval at the air curtain destructor site at all times for verification by state or local officials. (b) Burning exempted under section 3 of this rule does not require a letter of approval from the commissioner under this section. However, the burning shall comply with the conditions set forth in section 7 of this rule.
