Sec. 28.5.
"Federally enforceable" means all limitations and conditions which are enforceable by the U.S. EPA administrator, including those requirements developed for the following:
(1) Standards of performance for new stationary sources contained in 40 CFR 60 *.(2) National emission standards for hazardous air pollutants contained in 40 CFR 61 *.(3) Requirements within any applicable state implementation plan.(4) Any permit requirements contained in 40 CFR 52.21 * or under regulations approved under the review of new sources and modifications established in 40 CFR 51, Subpart I*. This includes operating permits issued under a U.S. EPA approved program that is incorporated into the state implementation plan and expressly requires adherence to any permit issued under such program. *Copies of the Code of Federal Regulations have been incorporated by reference and are available from the Superintendent of Documents, Government Printing Office, Washington, D.C. 20402 or the Indiana Department of Environmental Management, Office of Air Management, Indiana Government Center-North, 100 North Senate Avenue, Indianapolis, Indiana 46204-2220.
