Sec. 1.
(a) For purposes of this rule, an "area of hydrogen sulfide (H2S)" is an area with a minimum concentration of one hundred (100) parts per million or more in ambient atmosphere as determined by the division. The concentration of hydrogen sulfide (H2S) in the ambient atmosphere shall be ascertained by the owner or operator at the owner's or operator's expense: (1) upon the request of the division; or(2) when the owner or operator determines that hydrogen sulfide (H2S) may be present.(b) The results of testing under subsection (a) shall be reported to the division within ten (10) days of receipt of the test results.(c) The owner or operator of a well or facility associated with the drilling, operation, or plugging of a well for oil and gas purposes in an area of hydrogen sulfide (H2S) shall provide safeguards to protect the general public from the harmful effects of hydrogen sulfide (H2S) in accordance with this section.(d) When a well or facility associated with the drilling, operation, or plugging of a well for oil and gas purposes is located in an area of hydrogen sulfide (H2S), the owner or operator shall install wind direction indicators at strategic locations on or near a drilling rig, workover rig, or plugging rig, and at all production facilities, to indicate the wind direction at all times and the safe upwind areas in the event hydrogen sulfide (H2S) becomes present.Natural Resources Commission; 312 IAC 29-27-1; filed 12/1/2017, 10:35 a.m.: 20171227-IR-312160230FRAReadopted filed 1/17/2023, 1:53 p.m.: 20230215-IR-312220328RFA
