Sec. 132.
"Waste" includes the following:
(1) Locating, spacing, drilling, equipping, operating, or producing a well for oil and gas purposes drilled after March 13, 1947, in any manner that:(A) reduces or tends to reduce the quantity of oil or gas ultimately to be recovered from any well in this state; or(B) violates the spacing provisions adopted by the commission under IC 14-37 and this article.(2) Storing oil in earthen reservoirs except in an emergency to prevent the total loss of that oil.(3) Producing oil or gas in a manner that will cause water channeling or zoning.(4) Injecting fluids into a formation interval capable of producing oil or gas, except in accordance with the terms of a permit for a Class II well issued under this article.(5) Allowing water, other than fresh water, to flow from any producing horizon located in a producing pool, except in accordance with the terms of a permit issued under this article.(6) Allowing gas from a well that produces only gas to escape into the atmosphere, except as is necessary while making or changing connections, completing the well, or reconditioning the well.(7) Blowouts and other uncontrolled discharges of oil, gas, coal bed methane, or any other fluids from a well for oil and gas purposes.Natural Resources Commission; 312 IAC 29-2-132; filed 12/1/2017, 10:35 a.m.: 20171227-IR-312160230FRAReadopted filed 1/17/2023, 1:53 p.m.: 20230215-IR-312220328RFA
