Sec. 3.
(a) The department shall prescribe and furnish forms for filing performance bonds under section 6 of this rule.(b) The department shall prescribe terms and conditions for performance bonds and insurance that meet the requirements of this rule.(c) The department shall determine the amount of the bond under section 8 of this rule.(d) The department shall release liability under bonds under section 16 of this rule.(e) The department shall cause all or part of a bond to be forfeited under section 17 of this rule.(f) The department shall require in the permit that adequate bond coverage be in effect at all times. Except as provided in section 10(e)(2) of this rule, operating without bond coverage is a violation of a permit.
