Sec. 3.
(a) Upon petition, an area shall be designated as unsuitable for all or certain types of surface coal mining operations if the director determines that reclamation is not technologically and economically feasible under IC 14-34 and this article.(b) Upon petition, an area may be (but is not required to be) designated as unsuitable for certain types of surface coal mining operations if the operations will: (1) be incompatible with existing state or local land use plans or programs;(2) affect fragile or historic lands in which the operations could result in significant damage to important historic, cultural, scientific, or esthetic values or natural systems;(3) affect renewable resource lands in which the operations could result in a substantial loss or reduction of long range productivity of water supply or food or fiber products; or(4) affect natural hazard lands in which the operations could substantially endanger life and property, such lands to include areas subject to frequent flooding and areas of unstable geology.Natural Resources Commission; 312 IAC 25-3-3; filed Jun 21, 2001, 2:53 p.m.: 24 IR 3434, eff Dec 1, 2001; readopted filed May 29, 2007, 9:51 a.m.: 20070613-IR-312070146RFA; readopted filed Sep 19, 2013, 10:12 a.m.: 20131016-IR-312130125RFAReadopted filed 3/26/2019, 3:40 p.m.: 20190424-IR-312190011RFA
