Sec. 1.
(a) Permit applications, records, and other documents filed with the division under IC 14-24 and this article are subject to the requirements for access to public records contained within IC 5-14-3.(b) A person who wishes to claim the status of any document filed with the division as a trade secret must include with the filing a concise written statement of the part or parts of the document for which that status is claimed.(c) If a request for information is received from a person for a document described in subsection (b), the division shall make a reasonable attempt to contact the person claiming the protection as a trade secret to determine if consent to disclose can be obtained.(d) If consent to disclose cannot be obtained under subsection (c), the division shall inform the person making the request. That person may obtain administrative review under IC 4-21.5 and 312 IAC 3-1 of the status of the document as a trade secret.
