Section 312 IAC 10-2-36 - "Rural area for a construction or reconstruction project on a state or county highway bridge that crosses a stream having an upstream drainage area of fifty (50) square miles or less" defined

Sec. 36.

"Rural area for a construction or reconstruction project on a state or county highway bridge that crosses a stream having an upstream drainage area of fifty (50) square miles or less" means an area where:

(1) the flood protection grade of each residential, commercial, or industrial building impacted by the project is higher than the regulatory flood elevation under the project condition; and
(2) the area lies outside:
(A) the corporate boundaries of a consolidated city or an incorporated city or town; and
(B) the territorial authority for comprehensive planning established under IC 36-7-4-205(b).
