Section 2530.820 - Request for Hearing to Appeal Immediate Eviction and Removala) Any person who is issued a Notice of Eviction requiring him or her to remove himself or herself from Department lands shall have the right to appeal by filing two copies of a Petition for Hearing.1) Both copies of the Petition for Hearing shall be mailed to or filed with: Office of Legal Counsel

2) The petitions must be received by the Department no later than 30 days after the Notice of Eviction and Removal is served for the petition to be considered.b) If no petition is received within 30 days by the Office of Legal Counsel, the eviction and removal will be considered final without further notice.c) The petition shall be styled "In Re the eviction of (name), PETITION FOR HEARING". The petition shall contain sufficient facts in justification of a hearing and be signed by the Petitioner (person who was evicted).d) The party filing the petition shall be designated the Petitioner.
