Section 31.01.01.354 - CONSIDERATION OF SETTLEMENT ON APPEAL

When a settlement of an appeal calling for Commission action is presented to the Commission, the Commission will prescribe procedures under which the Commission will consider the settlement. For example, upon the parties' written request, the Commission might summarily accept the parties' settlement of an essentially private dispute that does not significantly implicate regulatory law or policy or for other utilities or customers summarily upon the affected parties' written request But when one (1) or more parties to the appeal is not party to the settlement or when the settlement presents issues that significantly implicate other utilities, other customers or the public interest, the Commission may convene an evidentiary hearing to consider the settlement's reasonableness and whether accepting the settlement would be in the public interest. In all cases, the Commission will follow the procedure established by Section 61-624, Idaho Code, with regard to altering, amending, or rescinding any order affected by the settlement.
