Section 6-74-27 - System emergencies(a) A qualifying facility shall be required to provide energy or capacity to an electric utility during a system emergency only to the extent provided by agreement between the qualifying facility and electric utility.(b) During any system emergency, an electric utility may discontinue: (1) Purchases from a qualifying facility if those purchases would contribute to the emergency; and(2) Sales to a qualifying facility, provided that the discontinuance is on a non discriminatory basis.[Eff 2/18/82; am and comp 5/2/85; comp] (Auth: HRS § 269-6) (Imp: HRS § 269-27.2)
