Section 6-74-8 - Qualification status(a) A small power production facility or cogeneration facility which meets the criteria for qualification set forth in § 6-74-4 is a qualifying facility.(b) The owner or operator of any facility qualifying under this section shall furnish notice to the FERC, commission, any electric utility located on the same island as the qualifying facility, and to any other electric utility to which the qualifying facility proposes to supply energy, or capacity, or both providing the information set forth in § 6-74-9(b), (c), and (d).(c) The approval granted to a qualifying facility is to the facility and not the owner or operator.
