Section 6-74-11 - Revocation of qualifying status(a) The commission may revoke its determination of the qualifying status of a qualifying facility if the facility fails to comply with any of the statements contained in its application to the commission pursuant to § 6-74-9.(b) Prior to undertaking any substantial alteration or modification of a qualifying facility which has been determined to be a qualifying facility under §§ 6-74-8 or 6-74-9, a small power producer or cogeneration or any electric utility may apply to the commission for a determination that the proposed alteration or modification will not result in a revocation of a qualifying status.[Eff 2/18/82; am and comp 5/2/85; am and comp] (Auth: HRS § 269-6) (Imp: HRS § 269-27.2)
