Section 23-200-12 - Records of controlled substances(a) Every physician, dentist, podiatrist, veterinarian or other practitioner shall keep a record of all controlled substances received, transferred, administered, prescribed, or disposed of as damaged or outdated, showing the amounts received, transferred, administered, prescribed, dispensed or disposed of for a period of five years. All records pertaining to the administration, dispensing or prescribing of controlled substance must be produced and made available upon request by the department or its agents.(b) Distributors, manufacturers, wholesalers, and their representatives shall keep a record of the controlled substance produced, distributed, received, and disposed of by them.(c) Pharmacies shall keep a record of all controlled substances received, dispensed, and disposed of by them.(d) Inventories and records of all controlled substances shall be maintained separately from all other business records.(e) Inventories or records of all controlled substances must be produced and made available upon request by the department or its agents.(f) The theft or loss of any controlled substance regulated by this chapter discovered by any person regulated by this part shall be reported to the department within 24 hours of the receipt of actual knowledge of the discrepancy.
