Section 19-42-34 - declining offer
(a) When an offer of any use permit, except a temporary permit, is provided, the department shall deliver the offer or send it by certified mail, return receipt requested, addressed to the applicant at the post office address furnished to the department in writing by the applicant.
(b) The department shall offer a temporary mooring permit to the applicant by telephone, personal service, or first class mail, postage prepaid addressed to the applicant at the post office address furnished to the department in writing by the applicant. If the senior applicant cannot be contacted after a reasonable effort, the next senior applicant will be offered the temporary mooring permit. Unless circumstances beyond the former senior applicant's control can be demonstrated, the former senior applicant shall lose seniority.
