Section 13-183-49 - Approval of leasing by public auction

If the occupier or the assignee of the right to obtain a mining lease fails to apply for a mining lease within six months from the date of notice from the board of its finding of public interest that the reserved lands be mined, a mining lease shall be granted by public auction under subchapter 4, provided that the bidders at the public auction shall bid on an amount to be paid to the State for a mining lease granting to the lessee the right to develop the geothermal resources reserved to the State. The board may also require the payment of a cash bonus, percentage of the net profit, or otherwise.
