Section 13-5-34 - Board permits
(a) Applications for board permits shall be submitted to the department in accordance with section 13-5-31.
(b) A public hearing, if applicable, shall be held in accordance with section 13-5-40.
(c) The application for a board permit shall be accompanied by:
(1) An application fee of $100, plus an additional $100 per potential developed acre, or major fraction thereof, up to a maximum of $2,000; and
(2) A public hearing fee of $250, if applicable.
(d) Contested case hearings, if applicable, and as required by law, shall be held as provided in chapter 13-1, subpart 5. The aggrieved appellant or person who has demonstrated standing to contest the board action may request a contested case hearing pursuant to chapter 13-1.
