An approval by EPA pursuant to 40 CFR 268.5 (procedures for case-by-case extensions to an effective date), 40 CFR 268.6 (petitions to allow land disposal of a waste prohibited under subpart C of 40 CFR Part 268), 40 CFR 268.42(b) (alternative treatment methods), or 40 CFR 268.44 (variance from a treatment standard) shall not constitute an approval by the State unless the department adopts the approval by rule(s) promulgated pursuant to chapter 91, HRS.
