Rule 520-4-.01 - Hearing Procedures(1) All hearings in "contested cases," as that term is defined in the Georgia Administrative Procedure Act (O.C.G.A. § 50-13-13), shall be conducted by the Office of State Administrative Hearings. All proceedings pending before the Office of State Administrative Hearings shall be governed by its rules and regulations. The Commission shall initiate all proceedings in contested cases by filing the requisite pleadings with the Office of State Administrative Hearings.(2) When the Commission denies an application for classification based on the applicant's failure to meet the requirements of O.C.G.A. § 43-40-15, notwithstanding the fact the applicant may have met the other requirements under O.C.G.A. § 43-40-15, the Commission shall notify the applicant of the denial and offer the applicant the opportunity to request a hearing before the Office of State Administrative Hearings.Ga.
