Rule 391-3-7-.08 - Enforcement(1) The administration and enforcement of these rules and regulations shall be in accordance with the Erosion and Sedimentation act of 1975, O.C.G.A. 12-7-1et seq.; the Executive Reorganization Act of 1972, O.C.G.A. 12-2-1et seq., and the Georgia Administrative Procedure Act, O.C.G.A. 50-13-1et seq., all as amended, but also includes the authority to require corrective action and/or remediation of conditions creating adverse water quality impacts, or otherwise in violation of these rules, regulations and authorizing statutes.(2) When the Division seeks to enforce the requirements of these rules or the requirements of O.C.G.A. 12-7-1 et. seq., as amended, in a jurisdiction covered by a certified local issuing authority, the Division should coordinate enforcement with the local issuing authority. However, coordination with a local issuing authority is not a prerequisite for enforcement by the Division.Ga. Comp. R. & Regs. R. 391-3-7-.08
