Section 59AER20-14 - Mandatory Entry to Conduct Voluntary COVID-19 Vaccinations of Assisted Living Facility Staff and Residents(1) APPLICABILITY. The requirements of this emergency rule apply to all assisted living facilities licensed under Chapter 429, F.S.(2) DEFINITIONS (a) "CDC" means the Centers for Disease Control and Prevention.(b) "COVID-19 Vaccination" means vaccinations provided in accordance with the CDC Pharmacy Partnership for Long-Term Care Program, or other state or federal programs, and vaccination-related follow-up.(c) "Authorized Representative" means the Florida Department of Health or its authorized agents, CVS Health or Walgreen Co., or other vaccination-approved pharmacies.(3) MANDATORY ENTRY TO CONDUCT COVID-19 VACCINATIONS.(a) Assisted living facilities must enroll in the CDC Pharmacy Partnership for Long-Term Care Program online at: http://ahca.myflorida.com/COVID-19_Facilities.shtml#facility no later than 11:59 p.m. on Thursday, December 3, 2020, including completion of all required information and pharmacy selection, and facilitate arrangements for residents and staff to voluntarily receive the COVID-19 vaccine, including making off-shift staff available at the facility for vaccinations.(b) Assisted living facilities shall allow Authorized Representatives entry into the facility for the purpose of conducting voluntary COVID-19 staff and resident vaccinations.(4) REVOCATION OF LICENSE, FINES OR SANCTIONS. For a violation of any part of this rule, the Agency may seek any remedy authorized by Chapter 429, Part I, or Chapter 408, Part II, F.S., including but not limited to, license revocation, license suspension, and the imposition of administrative fines.Fla.
