Section 5B-43.011 - Cancellations and Suspensions
(1) Issuance of certificates, limited permits, master permits, compliance agreements.
(a) Certificates. Certificates may be issued for the movement of regulated articles from a regulated area under any of the following conditions:
1. When, in the judgment of the authorized representative, regulated articles have not been exposed to infestation.
2. When regulated articles have been inspected by an authorized representative and found free of infestation.
3. When regulated articles have been treated under the supervision of an authorized representative in accordance with methods prescribed by the division.
(b) Limited permits. Limited permits may be issued by an authorized representative for the movement of noncertified regulated articles from a regulated area to specified destinations for limited handling, utilization, or processing. Persons shipping, transporting, or receiving such articles may be required by the division to enter into written agreement to maintain safeguards against the establishment and spread of infestation and to comply with procedures prescribed by the division as to, treatment, maintenance of identity, handling, or subsequent movement of regulated articles, and the cleaning of trucks, wagons, cars, aircraft, boats, containers, and other means of conveyance used in transportation of regulated articles.
(c) Master permits. Master permits, DACS-08047, revised 11/99, incorporated herein by reference, may be issued by the director for the movement of regulated articles from a regulated area. Copies of DACS-08047, Master Permit, may be obtained from the Division of Plant Industry, P.O. Box 147100, Gainesville, Florida 32614-7100.
(d) Compliance agreement. As a prerequisite to receiving a certificate or limited permit for the movement of regulated articles, any person engaged in purchasing, assembling, exchanging, processing, utilizing, treating, or moving regulated articles from a regulated area may be required to sign a compliance agreement, DACS-08031, Revised 5/99, incorporated herein by reference, stipulating that he agrees to carry out all conditions, treatments, precautions, and sanitary measures prescribed by the division. Copies of DACS-08031, Compliance Agreement, may be obtained from the Division of Plant Industry, Post Office Box 147100, Gainesville, Florida 32624-7100.
(2) Cancellation. Certificates, written agreements, master permits, or limited permits for the movement of regulated articles may be withdrawn or cancelled by the department for any violation of this chapter and issuance of additional certificates, permits, or written agreements for the movement of such articles may be refused by the division whenever it is determined that the use of such certificates, permits, master permits, or written agreements could result in the spread of a snail described in Rule 5B-43.003, F.A.C.
(3) Attachment. Each container of regulated articles, or the article itself, when moved from a regulated area must have a valid certificate or limited permit securely attached, except for such articles that are adequately described on a waybill or invoice and accompanied by a valid certificate or limited permit.
