Rule 8-A2554 - BUY AMERICAN ACT
2554.1

The provisions of the Buy American Act (the Act of March 3, 1933; 41 U.S.C. §10, also referred to in this section as "this Act") shall apply to all manufactured and unmanufactured articles, materials, and other supplies purchased by the School of Law unless the Director of Procurement (the "Director") determines in writing any one (1) of the following:

(a) That the supplies, materials, or other items are not available in sufficient commercial quantities to meet the requirements of the School of Law;
(b) That the cost of an item would be unreasonable;
(c) That the quality of an item is unsatisfactory; or
(d) That the purchase would be otherwise inconsistent with the best interests of the School of Law.
2554.2

The Director shall apply the penalty set forth in § 10 b of this Act to any contractor found to be in violation of this Act.

2554.3

In each contract for construction, alteration, or repair of any public building, the contracting officer shall insert a clause that requires compliance with this Act by the contractor, subcontractors, materiel men, and suppliers. The Director may approve exceptions to the requirements of this Act with respect to particular articles, materials, or supplies if the Director finds in writing that the specific requirement is impractical or would unreasonably increase the cost of the contract.
