If the STEP 2 grievance process, as set forth in § 805, does not resolve the grievance to the satisfaction of the employee, the STEP 3 grievance procedures set forth in this section may be followed by the employee.
An employee shall initiate the STEP 3 grievance procedures by filing the following materials with the Superintendent of Schools:
An employee shall file the STEP 3 grievance within five (5) working days of the receipt of the written answer to the STEP 2 grievance, or within five (5) working days of the date when the written answer should have been received.
The Superintendent of Schools or his or her designee shall hold a STEP 3 hearing on the grievance within ten (10) working days of the receipt of the STEP 3 grievance.
The STEP 3 hearing shall include the employee; the employee's representative, if any; and any other persons involved in the STEP 1 and STEP 2 processes or relevant to the resolution of the grievance who may be designated by the Superintendent or his or her designee to appear at the hearing.
At the STEP 3 hearing, one (1) person shall be designated as the chief spokesperson on each side; however, this shall not preclude the participation of any person attending the hearing pursuant to § 806.5.
The Superintendent or his or her designee shall give to the employee a written decision on the grievance within ten (10) working days of the STEP 3 hearing.
The written decision of the Superintendent of Schools or his or her designee shall be the final decision of the D.C. Public Schools on the grievance.
