Rule 4-1106 - NONRESPONSIBLE CONTRACTORS
1106.1

If a bidder or offeror fails either to submit a complete and satisfactory Affirmative Action Program or to submit a revised Affirmative Action Program that meets the approval of the Director, as required pursuant to this chapter, the Director may direct the Contracting Officer to declare the bidder or offeror to be nonresponsible and ineligible for award of the contract.

1106.2

Any untimely submission of an Affirmative Action Program may, upon order of the Director, be rejected by the Contracting Officer.

1106.3

In no case shall there be any negotiation over the provisions of specific utilization standards submitted by the bidder or offer or after the opening of bids or receipt of offer and prior to award.

1106.4

If any directive or order relating to nonresponsibility is issued under this section, the Director shall afford the bidder or offer or a reasonable opportunity to be heard in opposition to the action in accordance with § 118.1, or in support of a request for waiver under § 109.
