A finding of probable cause shall be based upon credible, probative, and substantial evidence which demonstrates a nexus between the harm complained of and the protected characteristic or activity of the complainant.
If the Director determines there is probable cause to credit the complaint, the LOD shall be served on all parties, advising them of the opportunity to conciliate.
If probable cause is found, the respondent shall have fifteen (15) calendar days to file for reconsideration based on misapplication of law, material misstatement of fact, or discovery of evidence not available during the investigation.
