Rule 31-336 - MOTION TO DISQUALIFY THE CHAIRPERSON OR MEMBER(S) OF A HEARING PANEL
336.1

Any party desiring that the Chairperson or a member of the hearing panel disqualify himself or herself from participating in a hearing shall file a motion supported by an affidavit setting forth the grounds for such disqualification within the period prescribed in § 334.

336.2

Failure to file a timely motion shall be considered a waiver of disqualification.

336.3

Application for leave to file an untimely motion seeking disqualification of the Chairperson or a member of the hearing panel shall be accompanied by an affidavit setting forth in detail why the facts relied upon as grounds for disqualification were not known and could not have been discovered with reasonable diligence within the prescribed time.

336.4

The Chairperson shall rule on all motions and his or her ruling shall be final, subject to review by the Panel. The decision of the Panel shall be final.
