Upon request by a consumer reporting agency, the Department shall make available information regarding an amount of overdue support, if the amount of overdue support is greater than one thousand dollars ($1,000).
The Department shall not make information available to a consumer reporting agency, if the amount of overdue support is one thousand dollars ($1,000) or less.
Upon receipt of a request for information from a consumer reporting agency in which the Department determines that an amount of support greater than one thousand dollars ($1,000) is overdue, the Department shall, within ten (10) days, notify the obligor in writing of the request, the identity of the requestor, the information the Department proposes to release, and the obligor's right to contest the accuracy of the information
The obligor shall have fifteen (15) working days from the date written notice is mailed by the Department to contest the accuracy of the information in writing. The Department shall review the written challenge to the accuracy of the information and notify the obligor of its decision within five (5) working days of receipt of the written challenge, after which it shall forward the information to the requesting consumer reporting agency.
